1. Agreement to Terms

Welcome to SpeedPesa. These Terms and Conditions ("Terms") govern your access to and use of SpeedPesa payment services, website, mobile applications, and related services (collectively, the "Services").

By accessing or using our Services, you agree to be bound by these Terms. If you do not agree to these Terms, you must not access or use our Services.

2. Description of Service

SpeedPesa provides digital payment processing services that enable businesses and individuals to send, receive, and manage payments through various channels including:

• Mobile money payments (M-Pesa, Airtel Money, Mixx by Yas, HaloPesa)
• Payment gateway integration for websites and applications
• Payout/disbursement services to mobile money wallets
• Transaction reporting and analytics
• API access for developers and businesses

We reserve the right to modify, suspend, or discontinue any aspect of our Services at any time without prior notice.

3. Account Registration

3.1 Eligibility

To use SpeedPesa Services, you must:

• Be at least 18 years of age
• Have legal capacity to enter into binding contracts
• Provide accurate and complete registration information
• Be a resident of Tanzania or operate a business in Tanzania

3.2 Account Security

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to:

• Keep your password secure and confidential
• Not share your account credentials with anyone
• Notify us immediately of any unauthorized access
• Log out from your account after each session

4. User Responsibilities

As a user of SpeedPesa Services, you agree to:

• Maintain and promptly update your account information
• Ensure all transactions are authorized and legitimate
• Comply with all applicable laws and regulations
• Monitor your account for unauthorized transactions
• Report any suspicious activity immediately

• Not attempt to interfere with or compromise system integrity

5. Transaction Limits & Fees

5.1 Transaction Limits

Transaction limits apply based on your account verification level and regulatory requirements:

• Daily transaction limits vary by account type
• Monthly transaction limits apply to all accounts
• Single transaction maximum limits apply
• Limits may be adjusted based on verification status

5.2 Fees and Charges

SpeedPesa charges fees for certain transactions as outlined in our Pricing Policy:

• Payment processing fees apply to incoming transactions
• Payout/disbursement fees apply to outgoing payments
• Fees are subject to change with prior notice
• All fees are displayed before transaction confirmation

6. Prohibited Activities

You agree NOT to use SpeedPesa Services for:

• Fraudulent or deceptive transactions
• Money laundering or terrorist financing
• Illegal gambling or betting activities
• Sale of prohibited or restricted goods
• Pornographic or adult content
• Pyramid schemes or multi-level marketing
• Unauthorized sale of financial instruments
• Any activity violating applicable laws

7. Intellectual Property

All content, features, and functionality of SpeedPesa Services are owned by SpeedPesa and are protected by international copyright, trademark, and other intellectual property laws.

The following are trademarks of SpeedPesa:

• SpeedPesa name and logo
• Website design and layout
• Software code and algorithms
• Documentation and user guides

7.2 Your Property

You retain ownership of your data and content submitted through the Services. By using our Services, you grant us a license to process and store your data as necessary to provide the Services.

8. Disclaimers & Liability

8.1 Service Disclaimer

SpeedPesa Services are provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to:

• Implied warranties of merchantability
• Fitness for a particular purpose
• Non-infringement
• Uninterrupted or error-free operation

8.2 Limitation of Liability

To the maximum extent permitted by law, SpeedPesa shall not be liable for:

• Indirect, incidental, or consequential damages
• Loss of profits, revenue, or data
• Service interruptions or delays
• Third-party actions or omissions
• Mobile network operator failures

9. Termination

9.1 By You

You may terminate your account at any time by contacting our support team. All pending transactions must be completed before termination.

9.2 By SpeedPesa

SpeedPesa reserves the right to suspend or terminate your account at our discretion, including but not limited to:

• Violation of these Terms
• Suspicious or fraudulent activity
• Extended period of inactivity
• Request by regulatory authorities
• Discontinuation of Services

9.3 Effect of Termination

Upon termination:

• Your right to use the Services ceases immediately
• Outstanding balances will be settled
• We retain rights to your data as per Privacy Policy
• Surviving provisions remain in effect

10. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United Republic of Tanzania.

Any disputes arising from these Terms or the use of our Services shall be resolved through:

1. Good faith negotiation between parties
2. Mediation through agreed-upon mediator
3. Arbitration in Dar es Salaam, Tanzania
4. Courts of Tanzania (if arbitration fails)

11. Changes to Terms

SpeedPesa reserves the right to modify these Terms at any time. When we make changes:

• We will update the "Last Updated" date
• Significant changes will be notified via email
• Changes take effect upon posting unless stated otherwise
• Continued use constitutes acceptance of new Terms
